Even though the Medicare Secondary Payer Act became law in December 1980, attorneys still struggle to comply with the statute’s primary requirement: to keep Medicare secondary any time a primary payment has been made. This one hour CLE will highlight new changes in CMS’ enforcement of the statutory requirements of the Medicare Secondary Payer act. We will discuss the new Civil Money Penalty Proposed Rule published in February 2020, the conditional payment enforcement actions by two US Attorneys offices against plaintiff’s firms, and CMS’ on-going efforts to ensure that Medicare remains the secondary payer to all settlement proceeds, including liability settlements, by use of a Medicare set aside arrangement.
