CMBA Offers Service For Co-Counsel Fee Disputes - CMBA News and Information

Before you sue your co-counsel over an unpaid legal fee, remember the Rules of Professional Conduct require that fee disputes between lawyers in different firms be resolved by a local bar association.  The CMBA’s Division of Fees Mediation and Arbitration Committee was established to mediate or arbitrate fee disputes between lawyers in co-counsel arrangements governed by Rule 1.5(f).  The Committee may also hear disputes between discharged and successor counsel regarding the proper allocation of contingent fees between them.

Arbitration hearings or mediations may be conducted in a conference room at the CMBA or via Zoom and are usually completed in two to three hours.   For a low fee, your fee dispute could be resolved quickly and efficiently by the CMBA.  Most importantly, information about the client’s case remains confidential.
