Earlier this month, the CMBA’s Legal Team was called upon to retrieve the client files of a Slavic Village lawyer who passed away suddenly. It took several hours to locate the active files and transport them to the CMBA’s Offices. The Team continues to field phone calls from clients and courts with concerns about cases. The Rules for the Government of the Bar permit the CMBA’s Certified Grievance Committee to appoint a lawyer to inventory the files of a lawyer who passes away. The costs of the inventory can be collected from the lawyer’s estate.
Solo practitioners can prepare for the “What Ifs” of business life with the help of the CMBA’s WIP Program. By taking advantage of the WIP program, you provide important information that can be used to protect your clients and help your family in the event of your death or disability. And if none of the scary “what ifs” come to pass, the information you compile will help you prepare to bring in a new associate or partner, sell your practice, or wind it down yourself.
